PLEASE READ TERMS AND CONDITIONS CAREFULLY AS YOUR BOOKING RETAINER IS CONFIRMATION THAT YOU ACCEPT AND FULLY UNDERSTAND ALL OF THE TERMS & CONDITIONS OUTLINED BELOW: Booking Terms and Conditions 1.1 For the purpose of these Booking Terms and Conditions, we, us, our, suppliers, and vendors refer to Bribie Island Pop Up Weddings and our contracted vendors who are providing their professional services to the couple through Bribie Island Pop Up Weddings. Client, you and your refers to the persons named in the booking form under the heading Client Info and are considered as the financially responsible for the services within the contract. 1.2 Once the booking retainer is received by Bribie Island Pop Up Weddings, it constitutes a binding contract between the client (you) and Bribie Island Pop Up Weddings and/or our contracted vendors. 1.3 Payment of the booking retainer is confirmation that you fully agree and abide by the Terms and Conditions as they are detailed below as well as available on the online booking form. Bribie Island Pop Up Weddings reserves the right to alter these Terms and Conditions and will notify you, the client, of any changes in writing. 2.0BOOKING RETAINER 2.1 Booking date and suppliers are NOT secure until a booking retainer has been received as clear funds. 2.2 Booking Retainer is considered a reservation fee to secure the client’s chosen event date and selected vendors included or elected in their chosen or negotiated wedding or event package. 2.3 Elopement, Cocktail Packages and Monday to Thursday events, require a $1,000 NON-REFUNDABLE booking retainer. For all other packages and Friday to Sunday Weddings, require a $2,000 NON-REFUNDABLE booking retainer. 2.4 Booking Retainer Payments are NON REFUNDABLE under any circumstance unless outlined in 4.0. 3.0 PAYMENTS 3.1 Payment in full, less the booking retainer already paid, is payable directly to Bribie Island Pop Up Weddings either via EFTPOS or electronic bank transfer to Bribie Island Pop Up Weddings nominated bank account as cleared funds 1 (one) calendar month prior to the event. 3.2 Early and progress payments are available upon request. 3.3 In the event final payment has not been received in full 7 (seven days before the event date, a ‘Late Payment Fee’ will be charged at a rate of 10% of the total cost of the invoice and Bribie Island Pop Up Weddings reserves the right to cancel the booking if full payment has not received prior to the event date without refund of any payments made. 3.3 You the client are responsible to ensure all monies owed are paid when due. 4.0 CANCELLATIONS/CHANGES TO BOOKINGS 4.1 Any requests for cancellation must be provided in writing via email ONLY, we will not consider or process any verbal or social media message cancellation requests under any circumstances. 4.2 Cancellations more than 6 months (182+ days) before booking date: 50% of all Payments made to Bribie Island Pop Up Weddings are refundable or can be transferred to another date. 4.3 Cancellations 6 months (181 days) or less before booking date: All payments made to Bribie Island Pop Up Weddings are not refundable or transferrable under any circumstance unless otherwise outlined in 5.1. 4.3 Transferred dates will incur a transfer fee of $500. 4.4 Clients are permitted to take up 3 months to decide on a new date and must select a date no more than 12 months from the date Bribie Island Pop Up Weddings is notified of the new date. Time is of the essence, if the client fails to select a new date within the 3 month grace period, all payments made will be forfeit. It is the responsibility of the client to select their new date within the 6 moth timeframe, Bribie Island Pop Up Weddings is not responsible to remind clients that time is of the essence. 4.5 Transferred dates are subject to availability of Bribie Island Pop Up Weddings and/or their associated suppliers. If original selected vendors are unavailable for the transferred date, a suitable substitute will be utilised. No refunds will be given for unavailability of single vendors, replacements will only be offered. 4.6 Transferred events are subject to increase of Bribie Island Pop Up Weddings, our suppliers and/or vendors service fees and general price increases due to seasonal supply and or any other associated costs relating to a transferred event date. 4.7 Any changes the clients choose to make to this agreement, such as additional guest numbers, optional extras etc. must be discussed with Bribie Island Pop Up Weddings via email ONLY. Final changes must be submitted via an amended booking form and resent to Bribie Island Pop Up Weddings. All changes must be agreed and submitted before final balance is due 1 (one) calendar month before event date. 4.8 Client changes to key Bribie Island Pop Up Weddings vendors including venue, photographer, celebrant, hair and makeup artist, cake decorator and stylist/decor hire, are not permitted once final details are confirmed and final payment is made 1 (one) calendar month before the event date. Reception venues may require an additional retainer, this will differ depending on the venue and chosen package. Additional Retainer will be subject to the venues own terms and conditions. 4.9 In instances where part of the booking is cancelled or changed 30 days (1 month) or less before event date are not transferable to another supplier and is not redeemable or carried over to an alternative date or event. Any requests for changes entailing a reduction of the price of the package, reduction of the duration, quantity and/or quality of the services or premises reserved, reduction in the number of guests, shall be deemed a total or partial cancellation, depending on the extent of the reduction. 4.10 In the event one or more of your suppliers and/or Bribie Island Pop Up Weddings become unavailable for your event and are forced to cancel part of your booking due to extreme sickness, family emergency and/or other extenuating circumstance, Bribie Island Pop Up Weddings will endeavour to find a suitable substitute vendor. Bribie Island Pop Up Weddings takes no responsibility for the availability if its vendors should they need to cancel. If Bribie Island Pop Up Weddings are unable to find a suitable replacement vendor, all monies paid by you for that particular service will be fully refunded. While Bribie Island Pop Up Weddings will endeavour to recommend suitable replacements, we will not be held liable for any additional costs incurred by you due to the cancellation including but not limited to additional costs to book another company as a replacement. 4.11 Bribie Island Pop Up Weddings reserves the right to consider that any partial cancellation representing over 50% of the total amount for the package constitutes a full cancellation.
5.0 COVID-19 POSTPONED DATES THESE TERMS ARE ONLY APPLICABLE TO WEDDINGS DIRECTLY EFFECTED BY COVID-19 – ALL OTHER TERMS APPLY *Accepted Conditions for postponed weddings are only if enforced government restrictions has forced your wedding to be postponed due to venue closure or boarder closures preventing the clients ONLY from attending the event date. If you postpone by your own preference, standard terms and conditions outlined above apply. 5.1 In the event your wedding is forced to be postponed directly due to COVID-19 (*conditions apply), Bribie Island Pop Up Weddings will transfer your booking retainer to another date without penalty or price increase. Clients are permitted to take up 6 months to decide on a new date and must select a date no more than 12 months from the date Bribie Island Pop Up Weddings is notified of the new date. Time is of the essence, if the client fails to select a new date within the 6 month grace period, all payments made will be forfeited. It is the responsibility of the client to select their new date within the 6 moth timeframe, Bribie Island Pop Up Weddings is not responsible to remind clients that time is of the essence. If you choose to cancel your wedding or no longer use Bribie Island Pop Up Weddings, standard cancellation terms outlined in 4.0 apply.
6.0 RELEASEPOLICY 6.1 Bribie Island Pop Up Weddings uses professional images and film from the weddings as promotional material on social media and our associated websites. The clients agree to Bribie Island Pop Up Weddings to use their wedding and professional images and film from their vendors to use for marketing purposes.
7.0 FORCE MANJEURE 7.1 Neither party may be held for any act, omission or circumstance due to an event beyond their control which that party could not have avoided with a reasonable effort, providing it advises the other party in detail and in writing, as soon as possible after the occurrence of the said event, and that it takes reasonable steps to remedy the situation quickly and remove the cause of those acts, omissions or circumstances. These acts, omissions or circumstances shall include but not be limited to:
War, declared or undeclared, revolution or action taken by public enemies; riots or civil disturbances; strikes, lock outs or work stoppage, affecting all or part of the Hotel staff; acts of God; fire, floods, storms; constraints imposed by any government or public authority; or any other cause that is reasonably beyond the control of one of the otherparty.
The duty to remedy any one of these causes quickly in no way includes the duty to end strikes or industrial conflict by accepting the demands of the other party orparties.
COVID-19 is not considered an unforeseen circumstance and clients must consider the ramifications of planning an event with the full knowledge of possible lockdowns and or closures related to COVID-19 restrictions.
8.0 HOUSE POLICY The key objective of Bribie Island Pop Up Weddings is to provide a safe and enjoyable environment for our clients and their guest and to ensure the behaviour of the guests does not adversely impact on the public, Bribie Island Pop Up Weddings staff, suppliers, or neighbours and the community at large.
Clients and Guests must treat each other and Bribie Island Pop Up Weddings staff and or the general public or otherwillbeaskedtoleavethe ceremonyarea.
Any guests attemptingtoconsumeliquor in a public area willbeasked to leave theceremony area and Bribie Island Pop Up Weddings takes no legal responsibility for consuming alcohol in public and or any other.
9.0 GENERAL INFORMATION AND POLICIES
9.1 CONTENT OF FUNCTION If Bribie Island Pop Up Weddings has reason to believe that an event or any part of it will affect the smooth operation of the responsibility of Bribie Island Pop Up Weddings commitment to the booked package, it’s security or reputation, the Management reserves the right to cancel/stop the function or any part of it at their discretion without notice or liability.
9.2 OUTSIDE CONTRACTORS Any outside contractors must liaise with Bribie Island Pop Up Weddings in all matters of delivery, set-up and break down in accordance with occupational health and safety code and indemnify against any liability or injury arising from the contracted event. The clients are required to inform all relevant persons involved in the organisation of the wedding, whether family, friends or contractors, of Bribie Island Weddings Pty Ltd Terms and Conditions outlined herein.
9.3 VENDOR COMMUNICATION To avoid and lessen confusion, Bribie Island Pop Up Weddings are to be the contact to the clients chosen vendors. The client is to discuss any and all dealings with Bribie Island Pop Up Weddings, and we will liaise with the vendors. If the client employs someone who is a personal friend or family, for example a relative is going to sing at the wedding, Bribie Island Pop Up Weddings require the name, email address and phone number of the person so we can email them with specifics to make sure they are advised of everything necessary.
9.4 VENDOR CONTRACTS All our suppliers and vendors require agreeance of their individual terms and conditions for each vendor involved in your event. The clients gives full authority to Bribie Island Pop Up Weddings to accept any and ALL supplier and vendor terms and conditions on behalf of the client. Client agrees that they accept all vendor terms in full.
9.5 ADDITIONAL SERVICES Bribie Island Pop Up Weddingswillarrangeavarietyofadditionalservicesuponrequest,suchasentertainment,technicalequipment,securitypersonnel,etc. The prevailing rates will beincurredfor any additional services. Ifthefunctionis cancelled,suchservicechargesare theresponsibilityofandpayableby theClients.
9.6 SIGNAGE No banners, signs or posters may be attached to any surface of the ceremony area without advance approval from Bribie Island Pop Up Weddings.
9.7 CONDUCT Itistheclientsresponsibilitytoensurealltheirguestsand individually hired contractor’sbehaveinanorderlymannerduringthefunction.Bribie Island Pop Up Weddings reserves the right to remove any guests from the ceremony area if they behave in a manner unreasonable or potentially disruptive towardsthewellbeingoftheotherguests, staffmembers and the general public.
9.8 RESPONSIBILITY Should Bribie Island Pop Up Weddings be unable to provide the facilities reserved due to circumstances beyond our control, no further claim other than the entitlement to a full refund of any retainer paid may be made. Bribie Island Pop Up Weddings will endeavour to provide the clients with reasonable notice. Wereservetherighttore-allocate ceremony areas.Ifweather conditions permit the change of ceremony location and the clients had not elected a wet weather plan, Bribie Island Pop Up Weddings takes no responsibility for the alternative location if clients do not approve. Whilst we will endeavour to find an alternative at late notice, we will not be responsible for any costs incurred and the clients are responsible for any and all costs incurred for the alternative venue, the cost to move vendors and or set up, pack up fees.
9.9 SMOKING POLICY Due to government regulations smoking is prohibited in all enclosed areas, beaches and most public areas. Restrictions apply to outdoor areas and smoking is only permitted in designated public areas. Bribie Island Pop Up Weddings takes no legal responsibility for clients and guests who smoke in non-permitted areas.
9.10 SURCHARGES AsurchargemaybeapplicableforeventsheldonSundaysandpublicholidays.A20%surchargewillapplytoeventsheldon all Public Holidays and their associated national holidays.
9.11 LOSS OR DAMAGE Bribie Island Pop Up Weddings will endeavour to take all possible care but accepts no responsibility for damage or loss of property left at any ceremony area prior to, during and after the event. SHOULD YOU WISH FLOWERS, STATIONERY, OR OTHER ITEMS TO BE KEPT FOR YOU AFTER THE CEREMONY, PLEASE ADVISE YOUR WEDDING COORDINATOR.
Bribie Island Pop Up Weddingsrecommendsthat clients and guestscarrytheirpersonablevaluablesatalltimesandsuggeststhattheClientsarrangeanindependent insurancepolicytocoversuchdamagesand/orlosses.ItisalsotheresponsibilityoftheClientstoprovidePersonalInsuranceCover for their guests. The Client is financially responsible for any damage sustained, or loss incurred, to Bribie Island Pop Up Weddings and their vendors property, whetherthroughtheirownactionortheactionoftheirguests,appointedagents,contractorsorsub-contractorspriorto, duringandafterthe event.The Clients aretoensurethatnothingisnailed,screwed,stapled,pinnedoradheredtoany council propertyor any othersurfacesorpart government property.
10.0 BOOKING CONDITIONS
The Clients are asked to read carefully all the provisions of the Contract concerning their event, to initial every page and sign the last page and to return the entire Contract to Bribie Island Pop Up Weddings within 7 days of the contract date (duration of the validity of theoffer).
The Contract must be duly dated and signed by the Clients and returned within the appointed time with the required part payments (see deposit schedule) for the Contract to be registered and the reservations made by the Client to be confirmed.
If Bribie Island Pop Up Weddings accepts a change prior to the Contract signed by both parties and receipt of first deposit, a new Contract offer shall be drawn up which shall cancel the previous offer. Any changes to provisions of the Contract after its signature shall not be effective until a rider has been drawn up and signed by both parties, of which the main Contract is an integral part.
The Clients or Clients representative/agent agrees to begin the event/s at the scheduled time/s and agrees to have its guests, invited and other persons vacate the designated ceremony area/s at the agreed completion time/s. Labour charges may apply if the event continues after the agreed completion time.
11.0 NON-DISPARAGEMENT By accepting the services or products, of Bribie Island Pop Up Weddings, you agree not to publish to any website, forum, or social media service negative reviews or disparaging comments or statements about Bribie Island Pop Up Weddings, its services, products, owners, suppliers or employees. When you use the website or purchase any service or product from Bribie Island Pop Up Weddings, you agree not to engage in any form of conduct or make any statements or representations that disparage or otherwise harm the reputation, goodwill, or commercial interests of Bribie Island Pop Up Weddings. You understand that should you violate this agreement, Bribie Island Pop Up Weddings will suffer irreparable harm and damages. You agree that actual damages would be difficult or impossible to ascertain. You further agree that liquidated damages in the amount of $25,000.00 per publication, posting, conduct, or statement that violates this agreement is a reasonable estimate of the damages incurred or to be incurred by Bribie Island Pop Up Weddings. You agree that the amount of liquidated damages is fair and reasonable and does not act as a penalty to you, but rather a reasonable fee associated with the damages Bribie Island Pop Up Weddings will suffer. You also agree that Bribie Island Pop Up Weddings may prevent or cure breach of this agreement by appropriate injunctive relief. By accepting the terms of this non-disparagement agreement, you authorise Bribie Island Pop Up Weddings to present this agreement to any online or print service provider as an agreement by you to allow Bribie Island Pop Up Weddings to request and authorise removal of any negative review or disparaging comment or statement. You agree that consideration has been exchanged between Bribie Island Pop Up Weddings and you to allow this agreement to be in full force and effect.
12.0 BRIBIE ISLAND POP UP WEDDINGS RIGHTS Bribie Island Pop Up Weddings has the right at any time to stop working with the client if we feel it isn’t a good fit. Client will not be reimbursed for any planning per hour pay. Bribie Island Pop Up Weddings has a no-tolerance bullying policy. Everyone on the Bribie Island Pop Up Weddings team will be treated with respect by our clients at all times, before, during, and after your event.
